Health Research, Incorporated (Rensselaer, New York, USA, www.HRInet.org) and Merial Limited (Duluth, Georgia, USA, www.Merial.com) announced today (October 1, 2004) that Health Research, Incorporated and Merial Limited v. Biomune Company and Zeon Corporation, Civil Case No. 1:03-CV-3621 (JEC), US District Court, Northern District of Georgia, resulted in a judgment that US Patent No. 5,505,941 - the recombinant avipox virus patent (prosecuted by Thomas J. Kowalski, Esq., of Frommer Lawrence & Haug LLP) - is valid, and enforceable in all respects. Judgment on Plaintiffs' charge of infringement by Defendants of the '941 patent also was entered in favor of Plaintiffs. Merial was represented by Judy Jarecki-Black, PhD, Esq., Merial's Global Head of IP. Plaintiffs Merial and HRI were collectively represented by Thomas J.
