Kevin Murphy is an experienced civil litigator and trial attorney specializing in pharmaceutical matters. Following graduation with honors from George Washington Law School in Washington, D.C. in 1994, he joined the Manhattan District Attorney’s Office as an Assistant District Attorney. There, he prosecuted a wide variety of crimes, ultimately trying 18 cases. Thirteen of those cases were jury trials. All resulted in the conviction of the defendants on trial.

In 1998, after moving to New Jersey, Mr. Murphy joined the large business law firm of Lowenstein Sandler PC, located in Roseland, New Jersey. There, he litigated, briefed and tried commercial cases on the trial and appellate level before the Courts and Administrative Hearing Boards of New Jersey and Pennsylvania. He also managed the defense of more than one hundred Multi-District and state court Medical Device cases involving latex allergy claims. Mr. Murphy was instrumental in devising the principal scientific defenses for those cases, and exposing the faulty scientific methods of a number of plaintiff’s experts and treating physicians.

In 2001, Mr. Murphy joined Frommer Lawrence & Haug. Since joining FLH, he has litigated and tried numerous cases for generic pharmaceutical and semiconductor companies.

In some of Mr. Murphy’s more recent matters, he:

  • Litigated and tried as lead chair a Hatch-Waxman case before the Southern District of New York involving the blockbuster drug Actos® for generic pharmaceutical company, Merck KgAA.
  • Litigated as lead counsel three patent enforcement actions against generic pharmaceutical companies competing with Par Pharmaceutical Companies, Inc. on Par’s multi-million dollar megestrol acetate product.
  • Litigated as lead counsel and second chair at trial a misappropriation of trade secrets case where jury awarded $9.9 million in damages for the client;
  • Pioneered novel theories in discovery for plaintiff against the New York Stock Exchange relating to its infringement of patents covering wireless technology on the trading floor; and
  • Managed numerous investigations leading to Hatch-Waxman notices of certification on behalf of generic pharmaceutical companies.
Mr. Murphy is admitted to the State and Federal courts of New Jersey, New York (including the Second Circuit Court of Appeals) and the Federal court for the Northern District of Illinois.
